Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CarValuator website, web application, and API (together, the "Service"), operated by CarValuator ("we", "us", or "our"). By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CarValuator provides estimated used-vehicle resale price ranges and related tools (such as a maximum-bid calculator and a history and profit tracker) generated with the help of artificial intelligence and market data. The valuations are estimates intended to help inform your own decisions. They are not appraisals, guarantees, or offers, and actual sale prices vary. You are solely responsible for your buying, bidding, and selling decisions.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

3. Accounts

You access the Service by signing in with your email address. You are responsible for the activity that occurs under your account and for keeping access to your email secure. Accounts are for a single user; you may not share, sell, or transfer your account or access, and we may limit the number of devices per account to prevent sharing.

4. Free Trial, Purchase, and Refunds

We offer a free trial for a limited period. After the trial, continued use of the app requires a one-time payment of $99.99 for lifetime access to the consumer app, processed by our payment provider. Because a free trial is provided before purchase, payments are generally non-refundable except where required by law or granted at our discretion. 5. API and Enterprise Use

API access is provided under separate commercial terms and any applicable order form or agreement. API keys are confidential and issued per client. You may not resell, redistribute, or expose the raw data or the API to third parties without our written permission.

7. Disclaimer of Warranties

The Service and all valuations are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement. We do not warrant that any valuation is correct or that the Service will be uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, CarValuator and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or losses arising from your reliance on any valuation or your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

9. Intellectual Property

The Service, including its software, design, and content, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. Your own inputs and saved records remain yours.

10. Termination

You may stop using the Service at any time. We may suspend or end your access if you violate these Terms or use the Service in a way that creates risk or liability for us.

11. Changes to the Service and Terms

We may update the Service and these Terms from time to time. Material changes will be reflected by updating the date above, and continued use after changes means you accept them.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in California.
